CRxAssured Acceptable Usage Policy

To be read in conjunction with Cegedim Rx Limited’s terms and conditions, software licence and coversure support and maintenance contract and the N3 acceptable usage policy.

 

Introduction

We have created this acceptable usage policy (AUP) to protect our resources, and the resources of our Customers and peering networks in order to provide a high speed network, high availability services and to ensure that as an ISP, we comply with all relevant UK laws. This AUP must be read in conjunction with our terms and conditions, software licence and coversure support and maintenance contract and the N3 acceptable use policy.

 

Terms and Conditions

Cegedim Rx Limited provides the CRxAssured product for explicit use as a wireless N3 backup solution intended for EPS data traffic and business critical internet services. It is the responsibility of all users of the Cegedim Rx Limited network and services to ensure that they comply with the latest edition of the AUP at any given time. This AUP may be revised, without notice, at any time, at the sole discretion of Cegedim Rx Limited. Completion of the relevant application form, or connection to the service for the first time, is deemed to be an agreement to our terms and conditions and this AUP.

In the event of a breach of this policy, Cegedim Rx Limited reserves the right to terminate all or part of any service with immediate effect, without recompense and delete any files held on our servers.

In the event of a breach of the paragraphs entitled “Internet Access” and “Irresponsible Usage”, Cegedim Rx Limited reserves the right to charge the Customer £0.10 per megabyte of the Customer’s use in breach of this policy.

 

Compliance with UK law

It is an offence under UK law to transmit, receive or store certain types of files. You, the Customer, may not use our services to engage in activities, or store, transfer or receive material of an indecent, offensive or otherwise illegal nature. Any such activities may result in prosecution by the UK authorities under the relevant criminal acts including but not limited to the Computer Misuse Act 1990, the Telecommunications Act 1984, the Protection of Children Act 1978, the Criminal Justice Act 1988 and the Prevention of Harassment Act 1997.

It is also a criminal offence under UK law to knowingly infringe intellectual property rights, such as copyright, patents, database rights and registered trademarks. The Customer is reminded that sharing copyright material through the use of peer to peer software may consequently constitute a criminal offence if done without the permission of the owner. Cegedim Rx Limited will co-operate with any agency or rights holder wishing to assert their rights in these matters and Cegedim Rx Limited reserves the right to withdraw service under such circumstances.

The Data Protection Act 1998 imposes numerous duties on users who process personal data relating to third parties. Failure to comply with many of these duties constitutes a criminal offence. Users who are not merely processing personal data for domestic (including recreational) reasons are reminded of their likely duty to register with the Information Commissioner.

Under the Electronic Commerce (EC Directive) Regulations 2002, we, as an ISP, are in general not liable to any criminal or pecuniary penalty for any unlawful acts carried out using our service unless we have actual knowledge of those unlawful acts.

Accordingly if we become aware of credible evidence that the Customer has carried out any unlawful act we will take preventative measures to bring those acts to an end.

 

Compliance with foreign law

The internet is global in reach. Consequently it is possible for the Customer to break the laws of foreign countries notwithstanding that the customer is based in the UK. The Customer must take all reasonable steps to avoid breaching relevant foreign laws.

 

Warranties and disclaimers

Our service warranties and the extent of our liability are explained fully in our terms and conditions.

By connecting to the Cegedim Rx Limited network, the Customer agrees to hold Cegedim Rx Limited harmless in the event of any legal claim regarding our services.

 

Irresponsible usage

The Customer acknowledges that they have a responsibility to ensure that their CRxAssured product is used for its intended proposes of transmitting business critical information only when the N3 landline is not functioning correctly and is not used in an irresponsible manner. Cegedim Rx Limited deems irresponsible use of the connection as including, but not limited to, general browsing of the internet, streaming of music and video, making VoIP calls such as Skype, accessing email accounts, IRC, instant messaging, sending unsolicited e-mail "spamming", attempting to breach the security of a third party machine, and flooding Usenet by placing a single post in a large number of newsgroups.

In the event that the Customer’s connection is used for any purpose that Cegedim Rx Limited deems irresponsible we reserve the right to suspend service while the usage is investigated in consultation with the Customer. Should investigation determine that the connection has been used irresponsibly Cegedim Rx Limited reserves the right to terminate the Customer’s account with immediate effect.

Wherever possible the Customer will be notified in advance of any termination.

 

Security and privacy

Login names and passwords must be kept secret and not be communicated to any third party. Cegedim Rx Limited must be notified immediately if they are compromised. The Customer should choose a memorable password.  If the Customer forgets or loses their password, they will need to contact the service desk to have it changed.

Cegedim Rx Limited will not guarantee the security or confidentiality of any data transmitted over our network. Where security or confidentiality is required, the Customer must provide their own end-to-end security mechanism.

 

Internet access

The Customer is responsible for all traffic that is sent from their connection. It is therefore the Customer’s responsibility to ensure that all software on the Customer’s side of the connection is virus-free and up-to date with all relevant security patches. In particular, server software running on public-facing ports, such as mail servers and proxy servers, must not be remotely exploitable. If we find malicious traffic emanating from the Customer’s connection, we have an obligation to our other Customers and peering networks to take urgent measures to block that traffic. In many cases, this can be achieved by selective port blocking, but in other cases, this will involve disconnecting and suspending the account until the issue has been resolved. We understand that in many cases, the Customer may not be responsible for or aware of the problem, we will work with the Customer to resolve the issue as efficiently as possible to restore normal service.

Cegedim Rx Limited reserves the right to suspend or cancel a Customer’s CRxAssured service if in the opinion of Cegedim Rx Limited that Customer’s usage is disproportionately high compared with the usage of other customers on similar services.

Any removal of the SIM card and insertion of it in any telephone, tablet or other analogous device for use is strictly prohibited under this policy and may incur charges as referred to above.

 

Attempted security breaches

Any attempt to breach the security of any machine is forbidden. Attempting to do so will result in immediate account termination and possible further legal action. Users may not run any program that monitors network packet data or any program that compromises the privacy of network traffic.

It should be noted that attempting to breach security may lead to prosecution under the Computer Misuse Act 1990 or any other relevant criminal legislation. Attempts to circumvent copy protection technology and encryption are also likely to be illegal under the Copyright Designs and Patents Act 1988 (as amended).

 

Non specific

Users may not mount an attack, by whatever means, against our system, or any other systems. Users may not run unauthorised mailing lists from, or through any of our machines, or mail servers.

Any IP addresses assigned to the Customer are owned by Cegedim Rx Limited. When using quota-based service, it is the Customer’s responsibility to remain within the Customer’s usage quota. Cegedim Rx Limited reserves the right to delete files for over-quota users if disk space is affecting the normal running of the server.

 

Service desk

The service desk exists for the benefit of Cegedim Rx Limited customers, providing support for questions relating directly to our services. The service desk is here to provide the best service possible to our customers, but can, at times, be stretched by having to answer unnecessary calls. When contacting the service desk, the Customer should ensure that they have all relevant details to hand, including details of any specific error messages encountered.

 

Your rights and how to contact us

Under the Data Protection Act 1998, you, the Customer, have a right to a copy of personal information which we hold about you. You can request this upon payment of a £10 fee by writing to:
